By accessing or using Tandem Beam ("the Service"), provided by Tandem Theory LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

These terms apply to all users, including advertisers, website operators, and any other parties who access the Service.

2. Description of Service

Tandem Beam is an analytics and attribution platform that provides:

  • Product analytics and event tracking
  • Multi-platform attribution tracking across advertising platforms
  • Conversion tracking and forwarding to advertising APIs
  • Real-time dashboards and reporting
  • Data export and integration capabilities

The Service requires installation of tracking scripts on your website(s) and configuration of advertising platform credentials.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use the Service to track users without appropriate consent or disclosures
  • Attempt to circumvent security measures or access unauthorized data
  • Use the Service for illegal activities or to violate others' rights
  • Interfere with or disrupt the Service or its infrastructure
  • Resell or redistribute the Service without authorization

5. Your Responsibilities

As a user of the Service, you are responsible for:

Privacy Compliance

Ensuring your use of the Service complies with applicable privacy laws (GDPR, CCPA, etc.) including obtaining necessary user consents.

Platform Terms

Complying with the terms of service of connected advertising platforms (Meta, Google, TikTok, etc.).

Data Accuracy

Ensuring the accuracy of data you provide and credentials you configure.

Website Disclosures

Maintaining appropriate privacy policies and cookie notices on your website(s).

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Tandem Theory LLC and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency repairs or security updates
  • Factors beyond our reasonable control

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANDEM THEORY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from these terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Tandem Theory LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms of Service
  • Non-payment of applicable fees
  • Conduct that we believe is harmful to other users or the Service
  • Upon your request

Upon termination, your right to use the Service will cease immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by posting a notice on the Service or sending an email to your registered address. Your continued use of the Service after changes become effective constitutes acceptance of the modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Texas.
